C'est vrai lui a fait preuve de courage en allant vers Tindouf au risque d'être liquidé pour expliquer ce que c'est que l'autonomie ( que tu défends parait il )et elle a choisi le chantage avec une supposée grève de la faim dans un aéroport espagnol.

Lui n'a pas pu rejoindre sa famille à Tindouf , elle se trouve à Laayoune.

UN Decolonization Committee: Comments on Western Sahara

The following comments were made on the question of Western Sahara to the UN Special Political and Decolonization Committee, by Katlyn Thomas, specialized attorney in international law, New York College, USA:

“Chairman, Ladies and Gentlemen of the Fourth Committee,

My name is Katlyn Thomas and I am an attorney who specializes in international law. Several years ago I served as the commission member of MINURSO responsible for legal issues, and was intimately involved in the preparation of the provisional list of persons eligible to vote in the referendum on Western Sahara. I wish to thank you for permitting me to speak today and to give my opinion on some of the issues involved in this dispute.

First, I want to state that in my opinion, and contrary to what you may have been told, there is no technical or other reason why a referendum could not take place if Morocco wanted it to take place and was willing to abide by the commitments it made to the United Nations, the Sahraouis and the international community in the 1991 cease fire agreements and Settlement Plan. The provisional voters list that MINURSO prepared was the culmination of years of hard work by a number of dedicated UN staff members under very trying conditions, and although certain other tasks remain to be completed before a referendum could take place, such tasks would not be impossible.

The reason why this referendum has not taken place is simple: Morocco does not want it to take place. I do not believe it is just a coincidence that Morocco decided to withdraw from the referendum process shortly after the provisional voters’ list was published in 1999. I believe the reason is clear: Morocco knows that if a free and fair referendum were held by people who were truly Sahraouis there would be an excellent chance that the Sahraouis would vote in favor of independence.

You will hear a number of people asserting that the Sahraouis in settlement camps in Algeria really would prefer returning to the “motherland” and that they are being forcibly prevented from doing so by Polisario leaders. Well, it appears to me that if the majority of Sahraouis really want integration with Morocco, Morocco should be bending over backwards to see to it that there is a referendum. After all, wouldn’t a vote for integration solidify its position in the territory once and for all? Instead, Morocco is doing everything possible to see to it that a referendum does not take place. There is a saying in the law “res ipsa loquitur” which means “the thing speaks for itself.” I think that Morocco’s actions speak for themselves.

I believe that Morocco is manipulating the United Nations for its own ends and that this is not the first time. In 1974, it convinced this committee and the General Assembly to postpone a referendum for the Sahraouis in order to enable it to seek an advisory opinion from the International Court of Justice on its legal claims to the territory. In 1975 the Court rendered its opinion rejecting Morocco’s claims in unequivocal terms and expressing its support for the Sahraouis right to self determination under international law. Within days of this holding Morocco sent troops to occupy the territory by force, thereby igniting a war that lasted more than 15 years.

Indeed, Morocco has shown little regard for the policies of this institution or principles of international law when they do not serve its purpose. In 2002 the United Nations legal advisor issued an advisory opinion holding that it would contravene principles of international law for Morocco to exploit the natural resources of Western Sahara in disregard of the interests and wishes of the Sahraouis. However, recent evidence suggests that Morocco, in defiance of that opinion, has continued to exploit for its own benefit the minerals and fishing resources of the territory. And as far as human rights are concerned, don’t you think it is illuminating that although the Polisario supports expanding the mandate of MINURSO to include monitoring human rights violations, Morocco does not?

I want to make it clear that I take no stand on the question of whether Western Sahara should be an independent state. I would be quite happy to see Western Sahara become an “autonomous region” of Morocco if that is what the people of Western Sahara should want. My concern is that they be given the right to choose. I am disturbed by those diplomats who believe that the issue of Western Sahara can be settled by forcing the Sahraouis to accept whatever “deal” is offered by Morocco. I can only state that the right to self determination under international law cannot be satisfied by limiting the choices available to a population to the one that is the most convenient for the international community.

In conclusion, I really do not blame Morocco for manipulating events – and this organization – to advance its own interests. No, I blame the international community for letting Morocco get away with it. I blame the members of the United Nations for failing to have the backbone to insist that Morocco abide by the terms of its cease fire agreement with the Sahraouis and the rules of international law.

In the end it will not be just the Sahraouis who will have suffered from the failure of the United Nations to uphold their right to self determination – the United Nations itself will be a loser. Following the Western Sahara debacle what nation or group of people can be expected to permit the United Nations to broker a settlement to a conflict of this sort? You must take steps to see to it that this conflict is resolved on honorable terms, if not for the sake of the Sahraouis, then for the sake of the United Nations itself.

Si la roublardise de Rabat n'est plus a demontrer, il ne faut pas perdre de vue qu'il existe d'autres facteurs qui empecheraient le Maroc d'accepter un etat independant au sed de ses frontieres. Le Maroc n'a meme pas le choix et meme s'il voulait se defaire du dossier SO, il ne le peut pas car:

1- Pour l'alliance atlantique, le positionnement de l'URSS sur la face est de l'atlantique serait une catastrophe dans l'equilibre des forces.
2- pour la France, ca sera la fin de son hegemonie sur la cote ouest de l'afrique et,
3- pour l'Espagne, en cas d'independance du SO, il est plus que probable que la situation fera ampirer ses problemes economiques avec la mise en chomage des disaines de milliers de pecheurs dans les eaux du SO.

Si on passe en revue tous les differents traites du Maroc avec les pays europeens, on pourra saisir le fil des evenements. Le Maroc n'est ni plus, ni mois qu'un point geostrategique de tres haute importance pour l'alliance atlantique a moins que le Polisario se range ce qui semble utopique.

La bataille depasse le Polisario et le Maroc aussi.

Madrid, qui soutient une solution politique au conflit du Sahara, constate l'application de la loi marocaine dans cette région

Madrid - La Présidence espagnole a constaté, dans communiqué rendu public jeudi soir à Madrid, que la Loi marocaine s'applique dans les provinces du sud du Royaume, alors que les efforts au niveau des Nations-unies sont en cours pour trouver une solution politique au conflit du Sahara.

L'Espagne a exprimé le voeu de voir les négociations de paix reprendre rapidement entre les parties au conflit, pour faciliter une solution politique, juste, définitive et acceptable".

"Pendant que l'on trouve une solution au contentieux du Sahara et en conformité avec la position des Nations Unies, l'Espagne constate que la Loi Marocaine s'applique au Sahara", précise le communiqué.

Le gouvernement d'Espagne partage la préoccupation de la communauté internationale pour que dans les prochaines semaines les conditions puissent être réunies pour de nouvelles négociations du processus de Manhasset, des négociations qui doivent avoir lieu dans le cadre des principes et accords des Nations Unies pour faciliter une solution politique, juste, définitive et acceptable par les parties, ajoute le communiqué.

Le gouvernement espagnol lance "un nouvel appel aux autorités Marocaines pour qu'un retour de Aminatou Haidar puisse avoir lieu dans le plus bref délai ", en raison de l'aggravation de " la situation humanitaire de cette dame ", selon les termes du communiqué.

"Le président du gouvernement espagnol, José Luis Rodriguez Zapatero et son ministre des Affaires étrangères ont entrepris ces derniers jours des démarches auprès des autorités Marocaines pour rendre possible le retour de Aminatou Haidar", souligne la même source.

Selon le gouvernement espagnol, ce geste (le retour de A. Haidar), "fera honneur à sa Majesté le Roi du Maroc et aux autorités du Royaume du Maroc, et mettra en relief, une nouvelle fois, son engagement pour la démocratie et la consolidation de l'Etat de Droit".

"Le gouvernement d'Espagne salue la politique de modernisation et de réformes entreprises par les autorités du Royaume du Maroc et s'engage à l'accompagner. Dans ce sens, le gouvernement réaffirme sa volonté d'approfondir sa coopération dans le cadre du statut avancé convenu entre l'Union Européenne et le Maroc", conclut le communiqué.
